Opposition to a payment order to pay

Following an order for payment procedure, when a debtor receives notification of the injunction order to pay issued by the trial judge, two reactions are possible:

- if the debtor does not respond within a month, the judge's decision enforceable, allows the creditor to present, by a bailiff, the debt to the debtor, which in default may be entered.

- following the notification of the decision, the debtor may within one month to oppose the order.


In this case, it can appeal by letter the district judge, or to challenge the basis, the amount of the debt or the jurisdiction of the court or to demand payment deadlines (Article 1244-1 of the Code Civil).

Judge will convene the two parties and render a decision in the usual manner.
