As part of a case before the courts, the applicant may terminate the trial by abandoning its demand (when a transaction with the other party has been established or if the chances of a favorable ruling him appear compromised).
The removal of actions normally mean the agreement of the opponent. However, for non-acceptance, the judge may declare the discontinuance perfect.
The withdrawal of the plaintiff may be implicit (non-delivery of an assignment for example) or explicitly (by judicial or extra-judicial), but is not presumed.
The withdrawal gives the parties agreed to the condition they were before proceeding.
Unless otherwise agreed, the costs of the trial will be borne by the applicant withdraws.
